General Terms and Conditions of Sale
These general terms and conditions of sale (hereinafter referred to as "GTC") govern all sales of products offered on the website of Joséphine Paris, a registered trademark of EURODES SARL with a capital of €650,000, registered with the Trade and Companies Register under number Arras B 539 098 54, with its registered office at 140B rue de Rennes – 75006 Paris, France (hereinafter referred to as "the Company"). These conditions apply to any order placed on the website www.josephine-paris.com (hereinafter "the Site").
Please read these terms and conditions carefully before placing any order. By validating your order, you unconditionally accept these terms and conditions.
Article 1: Purpose
These terms and conditions define the terms of sale between the Company and any natural or legal person, customer (hereinafter "the Customer"), in the context of an order placed on the Site for the purchase of leather goods (hereinafter "the Products").
Article 2: Products
Joséphine Paris offers leather goods made in France, crafted from high-quality French calfskin. Each product receives meticulous attention to its design and manufacture, respecting the brand's tradition and values, particularly durability and excellence.
The Product descriptions on the Site are for informational purposes only and may be modified without notice depending on product developments.
Article 3: Order
3.1 Order Placement
To place an order, the Customer must follow these steps:
- Select the desired products
- Add Products to Cart
- Validate the cart and choose the delivery address.
- Choose the payment method
- Confirm the order after verifying the information.
3.2 Order Confirmation
Once the order has been validated by the Customer, the Company will send them a confirmation email summarizing the order details (products, quantities, price, delivery address, etc.). This confirmation constitutes a contract between the Company and the Customer.
The Company reserves the right to refuse an order if the Products are out of stock or in case of payment problems or incorrect information.
3.3 Order Modification
No changes to the order can be made once it has been confirmed.
Article 4: Price
Product prices are shown in euros (€) and include the value-added tax (VAT) applicable in France. Delivery, customs and other charges may be added to the order and will be clearly specified during the ordering process.
The Company reserves the right to change its prices at any time, but the applicable prices will be those in effect at the time the order is confirmed.
Article 5: Payment
Payment for the order is made exclusively by credit card, via the secure payment platforms offered on the Site. Accepted cards include: Visa, MasterCard, American Express, and other available electronic payment methods.
The total amount of the order will be debited from the Customer's bank account upon order confirmation.
Article 6: Delivery
6.1 Delivery times
Products are shipped to the delivery address provided by the Customer at the time of ordering. The estimated delivery time will be specified in the order summary. Generally, orders are shipped within 2 to 4 business days.
6.2 Delivery charges
Delivery costs are calculated based on the weight and destination of the Products. They will be communicated to the Customer upon order completion.
6.3 Delay or delivery error
The Company strives to deliver the Products within the indicated timeframe. However, delays may occur due to exceptional circumstances. In the event of a delay exceeding 10 business days, the Customer may request cancellation of their order and a full refund of the amounts paid.
Article 7: Right of withdrawal
In accordance with Article L121-21 of the French Consumer Code, the Customer has a period of 14 days from receipt of the Products to exercise their right of withdrawal without having to justify their reasons. The Customer must notify the Company of their decision to withdraw, by email or registered letter with acknowledgment of receipt, within this period.
7.1 Product Returns
The Customer must return the Products in their original condition, unused and undamaged, along with the purchase invoice. Return shipping costs will be the responsibility of the Customer.
7.2 Refund
In the event of exercising the right of withdrawal, the Company will refund the amounts paid within 14 days of receipt of the returned Products, provided that the returned products are in their original condition, unused and undamaged…
Article 8: Warranty and Compliance
The Products sold on the Site benefit from the legal guarantee of conformity and the guarantee against hidden defects provided for by current legislation. In case of non-conformity or hidden defects, the Customer must contact the Company within 15 days of receipt of the product.
Article 9: Liability
The Company implements all necessary measures to ensure the quality and security of transactions on its Site. However, its liability cannot be engaged in cases of force majeure, incidents related to transport services, or technical problems beyond its control.
Article 10: Intellectual Property
All elements of the Site (texts, images, logos, etc.) are the exclusive property of the Company or its partners. Any unauthorized reproduction, use or modification of these elements is strictly prohibited.
Article 11: Personal Data
The collection and processing of personal data are carried out in compliance with current legislation (French Data Protection Act and the General Data Protection Regulation - GDPR). The information provided by the Customer is used exclusively for order processing. The Customer has the right to access, rectify, and delete their personal data.
Article 12: Applicable Law and Jurisdiction
These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, the Client may bring proceedings before the competent court of the defendant's place of residence or the place of performance of the order.
Article 13: Modifications to the General Terms and Conditions of Sale
The Company reserves the right to modify these General Terms and Conditions of Sale at any time. The modifications will be applied as soon as they are published on the Site. The Customer will be informed of any significant modification to the General Terms and Conditions of Sale with their next order.
